1. Who we are
This site belongs to Ziemtinel Global Cyberdefense Partner Ltda., RUT 78.255.165-5, with address at Av. Independencia 1376, Puente Alto, Región Metropolitana, Chile, trading under the Ziemtinel brand. By using the site or contracting any of our services you accept these conditions.
2. What we sell, and what we do not
We offer three different things, and they should not be confused:
- Documentation (Kit Docs) — templates in editable format, aligned with the regulation stated in each case. They are delivered once, with a single payment and no subscription.
- Consulting — professional diagnostic and regulatory implementation services, contracted through a specific proposal.
- Training — awareness programmes for the staff of the contracting company.
Selling documentation is not the same as certifying your organisation, nor does it guarantee that you will pass an audit or an inspection. The templates are a professional starting point that you must adapt to your own reality and keep up to date. Compliance depends on what your organisation does, not on the documents it has filed away. Nor do we provide legal advice: if you need a legal opinion, consult a lawyer.
3. How the purchase works
When you confirm the basket, a pre-order is generated with your billing details and you are sent to Flow, which processes the payment. We never see or store your card details at any point.
Once the payment is confirmed, delivery is automatic and by email: you are sent a compressed, encrypted file together with the password to open it. Check your junk mail folder before writing to us. If an hour goes by and nothing has arrived, contact us and we will sort it out.
Prices are shown in the currency and with the taxes stated on each page. The tax document is issued according to the details you enter at the time of purchase.
4. Right of withdrawal and refunds
The documentation is digital content delivered immediately. Under article 3 bis of Law 19,496, the right of withdrawal does not apply once the content has been delivered and downloaded, unless the product is defective.
If what you received does not correspond to what was purchased, arrives damaged or cannot be opened, write to us at contacto@ziemtinel.cl within 10 calendar days and we will replace it or refund you, whichever you prefer.
5. What you may do with the documentation
On purchase you receive a for internal use, indefinite and non-exclusive licence for the organisation named in the order. You can edit the documents, adapt them, brand them and use them with auditors, clients and authorities.
You may not, on the other hand:
- resell, transfer or distribute them outside your organisation;
- publish them in a way that makes them accessible to third parties;
- use them to provide consulting services to other companies.
If you are a consultancy and want to use them with your clients, a different licence applies: write to us.
6. Access accounts
Where the contracted service includes access to a platform, you are responsible for the confidentiality of your credentials and for the activity carried out with them. Tell us immediately if you suspect unauthorised use. We may suspend an account used to breach these conditions or the security of the service.
7. Site availability
We aim to keep the site available at all times, but we do not guarantee uninterrupted operation: there may be outages due to maintenance or to causes beyond our control. Temporary unavailability of the site does not give rise to a refund of documentation already delivered.
8. Liability
We answer for failures attributable to us under Chilean law. We are not liable for the consequences of your not adapting, implementing or keeping the documentation up to date, nor for the decisions you take on the basis of it, nor for the outcome of third-party audits or inspections.
None of the above limits the rights granted to you on a non-waivable basis by Law 19,496 on the protection of consumer rights.
9. Personal data
The processing of your data is governed by our Personal Data Processing Policy, which forms part of these conditions.
10. Changes, governing law and contact
We may update these conditions; the version in force is always the one published on this page, with its date in the heading. Changes do not affect purchases already made.
These conditions are governed by Chilean law, and any dispute will be submitted to the ordinary courts of justice with jurisdiction under the general rules, without prejudice to the actions that Law 19,496 allows you to bring before the local police court for your place of residence.
